Today is May 6, 2024. The following notices arrive in the mail. What date do you calendar for each?

 

1. A Request for Evidence (RFE) dated April 22, 2024, asking for a certified translation of a birth certificate. The regulations grant 85 days to respond, with an extra 3 days added if the notice was delivered by mail.

 

2. A final order of the immigration judge dated April 29, 2024 denying a client’s request for asylum and ordering removal. The regulations grant 30 days from the date of decision in which to file an appeal. There is no provision for extra time for mailing.

 

3. A Notice of Intent to Deny (NOID) an adjustment case dated April 26, 2024, for which 30 days to respond is granted, and the regulations grant an additional 3 days if received by mail.

 

4. A scheduling order sent by the immigration judge on April 20, 2024. It states that all briefing and evidence are due no later than 15 days before the final individual hearing scheduled for September 30, 2024.

 

5. A denial of an appeal by the Board of Immigration Appeals (BIA) dated April 24, 2024. Calendar the date for filing the Petition for Review (PFR) with the Fifth Circuit Court of Appeals.

 

6. Communication exercise: A client who has lived in the United States for 25 years as a lawful permanent resident has hired your firm to represent him in his N-400 Naturalization case. The attorney has already completed the intake, and has assessed that the client is eligible. The attorney has asked you to contact the client and request: 1) a copy of the front and back of the client’s LPR card; 2) send the client an N-400 questionnaire; ask the client for 2 passport-style photos; and 3) prof of the client’s selective service registration.
